What is the difference between human-made laws and Islamic Shariah? To understand that, we must first know the stages through which human-made laws evolved to reach their present form. Setting aside differences in details, legal scholars and historians generally state that human-made laws originated with the emergence of families and tribes.
When individuals within a family began to seize or deny the rights of others according to their own desires, people realized the necessity of establishing common rules to protect everyone's rights. Naturally, such laws were greatly influenced by the customs, traditions, and practices of the respective families and tribes.
For this reason, different tribes developed different laws in accordance with their varying perspectives and ways of life. As time passed, political awareness among tribes grew stronger, which eventually led to the formation of states. It was during this stage that laws began to be unified and made applicable to all members of society.
